Vivek Jayaram of the Jayaram Law, represents the NRI Academy of Sciences, a medical college and public hospital in Hyderabad, India. In 2012, the firm filed a lawsuit in Federal Court against the Indo-American Health and Education Foundation (“IHEF”) and its President, Dr. Apparao Mukkamala (also a director of NRI), for converting funds belonging to the medical school.
After immediately obtaining an injunction in the Eastern District of Michigan freezing the defendants’ assets in an effort to recover medical school funds, a two-year dispute ensued over whether or not the Eastern District of Michigan had jurisdiction over the dispute, and whether the firm’s clients had the proper standing to sue in the name of the medical school.
Earlier this month, the Honorable Bernard Friedman of the Eastern District of Michigan uniformly ruled in favor of Mr. Jayaram’s clients and concluded that the American Federal Court has jurisdiction over the dispute, and further found that the individuals who hired Jayaram Law to file suit on behalf of NRI had standing to bring its claims in Michigan. Most recently, the Court sent the entire dispute to binding arbitration (over the defendants’ vigorous objections), and recently denied an omnibus motion to reconsider those proper findings.
